Terms and Conditions
These terms explain the rules for accessing and using Kybern.ai, including workspace accounts, AI-assisted features, integrations, workspace storage configuration, and customer content processed through the platform.

By using Kybern.ai, you agree to the current version of these terms, including how customer content may be processed and stored where reasonably necessary to operate the service. Please review this page periodically for updates.
1. Acceptance of these terms
These Terms and Conditions govern your access to and use of Kybern.ai, including the kybern.ai website, applications, APIs, and related services.
By creating an account, accessing the platform, or using any Kybern.ai service, you agree to be bound by these terms. If you are using Kybern.ai on behalf of a company or other organization, you confirm that you have authority to bind that organization to these terms.
2. Eligibility and account responsibility
You must provide accurate account information and keep your login credentials secure. You are responsible for activity that happens through your account, including activity by team members or anyone you permit to use the service under your workspace.
You must notify Kybern.ai promptly if you believe your account or credentials have been accessed without authorization.
3. Permitted use
You may use Kybern.ai only in compliance with applicable law and only for legitimate business purposes connected to your organization.
- interfere with, disrupt, or attempt to gain unauthorized access to the service or its supporting infrastructure;
- upload or transmit unlawful, infringing, deceptive, or malicious content, including malware or harmful code;
- reverse engineer, copy, resell, or exploit the service beyond the rights explicitly granted in these terms;
- use Kybern.ai to violate privacy, intellectual property, employment, consumer protection, or data protection obligations.
4. Customer data and content
You retain ownership of the data, files, prompts, documents, and other content that you or your users submit to Kybern.ai. You grant Kybern.ai the limited rights needed to process, transmit, display, secure, index, and otherwise handle that content as necessary to provide, maintain, and protect the service.
Depending on workspace configuration, customer-uploaded business files and assets may be stored in AWS S3 or comparable object storage configured for the relevant customer or company workspace. Kybern.ai may also store related metadata and service records reasonably necessary to index, secure, retrieve, display, administer, support, and manage those files and the associated services.
Where applicable features are enabled, those records may include file indexes, message content, support records, HR conversation archives, AI call records, notifications, and audit events. Not all features are enabled in every workspace. You are responsible for ensuring that you have the rights and permissions needed to submit content to Kybern.ai, to instruct Kybern.ai to process it, and to configure any connected storage or third-party services used by your workspace.
5. AI-assisted features
Kybern.ai may provide AI-assisted features that help generate, summarize, classify, draft, or transform content. AI-generated outputs may be incomplete or inaccurate and should be reviewed by a qualified human before you rely on them for legal, financial, operational, compliance, hiring, or other important decisions.
You remain responsible for your use of any output generated through the platform and for confirming that the output is appropriate for your specific use case.
6. Integrations and third-party services
Kybern.ai may connect with third-party platforms, data providers, storage services, analytics tools, or communication systems. Your use of those third-party services may also be governed by their own terms and privacy policies.
Kybern.ai is not responsible for third-party services, third-party downtime, or losses caused by systems outside Kybern.ai's reasonable control.
7. Subscription, billing, and plan changes
If you subscribe to a paid plan, you agree to pay the applicable fees, taxes, and charges associated with your selected plan. Unless otherwise stated in a separate agreement, subscriptions renew automatically for the same renewal term.
Kybern.ai may change pricing, features, or plan limits in the future. Material changes will apply prospectively and will be communicated through the service, your account, or another reasonable channel.
8. Availability, updates, and suspension
Kybern.ai may update, improve, modify, or discontinue features from time to time. We aim to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation.
Kybern.ai may suspend or restrict access if necessary to protect the platform, comply with law, prevent abuse, respond to security concerns, or address non-payment or material breaches of these terms.
9. Intellectual property
Kybern.ai and its related branding, software, design, documentation, and service materials are protected by intellectual property laws. Except for the limited right to use the service under these terms, no ownership rights are transferred to you.
Feedback you provide about Kybern.ai may be used by Kybern.ai without restriction or compensation, provided that doing so does not disclose your confidential information.
10. Disclaimers
Kybern.ai is provided on an "as is" and "as available" basis to the maximum extent permitted by law. Kybern.ai disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free.
No information or output made available through the service should be treated as legal, tax, accounting, employment, investment, or regulatory advice.
11. Limitation of liability
To the maximum extent permitted by law, Kybern.ai will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities arising out of or related to your use of the service.
To the maximum extent permitted by law, Kybern.ai's total liability for claims arising out of or relating to the service will not exceed the amount you paid to Kybern.ai for the service during the twelve months before the event giving rise to the claim, or one hundred euro if you have not paid any fees.
12. Termination
You may stop using the service at any time. Kybern.ai may terminate or suspend your access if you materially breach these terms, create risk for the platform or other users, or if continued service is no longer commercially practical or legally permitted.
Sections that by their nature should survive termination, including provisions on ownership, disclaimers, liability, payment obligations, and dispute-related matters, will continue after termination.
13. Changes to these terms
Kybern.ai may revise these terms from time to time. When changes are material, Kybern.ai will post the updated version on this page and may provide additional notice through the product or by email.
Your continued use of the service after updated terms become effective means you accept the revised terms.
